Jayuya adopted its public nuisance regulation through Ordinance No. 42, Series 2024-2025, passed by the Municipal Legislature on May 27, 2025 and signed by the mayor on May 28, 2025.1 It repeals an ordinance that had been on the books for twenty years (No. 42 of the 2003-2004 series). It is a regulation with its own personality: it counts deadlines in working days, brings vehicles and boats into the nuisance definition, and sets its quarterly fine at $3,000. This guide walks through all of it and closes with what Act 97-2026 left outdated.
What counts as a nuisance in Jayuya: more than houses
The local definition goes beyond the Code's: any building, uninhabited structure, abandoned lot or vehicle that threatens safety or harms health and well-being.4 The modalities spell it out: structures in ruins, unfenced or debris-filled vacant lots, abandoned vehicles (including trailers, boats and heavy machinery without plates or dismantled),5 properties used for illicit activities such as drug trafficking,6 obstructions on public roads and easements, and the accumulation of junk or materials visible from the public way.
One important precision: the expropriation and acquisition framework of Chapter IV of the Municipal Code is designed for real property (structures and lots). Jayuya's extension to vehicles and other movable property rests on the municipality's general power to fine by ordinance, not on the nuisance expropriation process.

How a case begins and your 30 working days
A case can start three ways: a citizen complaint (with a form, in writing and even confidential, with address, photos or testimony),7 the Municipality's own initiative through Public Works, Permits or the Municipal Police, or a referral from state or federal agencies such as Health, Natural Resources, Housing or the Fire Bureau.8 Each property gets an individual file with its inspection report, photographs, and the owner search at the Property Registry and CRIM.
If there are grounds, the Municipality serves a preliminary determination, personally or by certified mail; if whereabouts are unknown or the property is unrecorded, it publishes the unknown-person notice in one print newspaper and one digital outlet, with no prior court order.9 From the notice you have thirty (30) working days to oppose and request a hearing before an Examining Official, a more generous term than the Code's 30 calendar days.10 If you neither appear nor oppose, default is entered and the Municipality issues the final determination without holding a hearing.11
The hearing and the orders
The Examining Official is, correctly, a licensed engineer or attorney (the Municipality may contract one, charging the cost to the proceeding, or reach a collaboration agreement with another municipality).12 The hearing is noticed no less than ten (10) working days in advance,13 and there you may appear on your own, with counsel or through an authorized agent, present evidence and rebut the municipal proof.
The resolution can come out three ways: dismissal (not a nuisance); repairable, with up to thirty (30) working days to repair or clean, justified extensions (the Municipality weighs in within ten working days) and a combined total that never exceeds one (1) year;14 or demolition at the owner's expense within up to thirty (30) working days, with a single extension of up to ninety (90) working days.15 Once the terms lapse, the Municipality executes at its own expense and records the lien at the Property Registry.

Fines are paid at the Municipality's Collections Office within sixty (60) working days of notice;18 otherwise they join the tacit mortgage lien. One particular detail: if the property is unrecorded at the Registry, the Municipality may opt to include the fines and costs directly in an expropriation action.19 And if collection efforts fail for another sixty (60) working days, the court action follows to foreclose and sell the property at public auction, depositing any remainder in a separate account from the general fund.20
Buying a nuisance property in Jayuya: the Code governs
Unlike other recent municipalities, Jayuya's regulation did not build its own acquisition procedure: there is no intent-plus-deposit process, no affordable housing protocol, no local repurchase clause. That means buying is governed directly by the Municipal Code: the Article 4.012 letter of intent with its appraisal-plus-10% deposit, the summary route of Article 4.012A with its priority for buyers of properties rehabilitable as residences, or the 2.018 auction model. The effects of the declaration are spelled out: official signage on the property, appraisal (by a licensed appraiser or CRIM), tax debt certification, and the expropriation track for public utility, affordable housing or the summary procedure. When calculating just compensation, CRIM debts are deducted from the appraised value; and here is the big incentive for buyers: once the transfer to the Municipality is complete, the tax debts, interest, surcharges and penalties with CRIM are extinguished in full, along with any accumulated municipal administrative fine or expense.21
The Municipality also keeps a Public Nuisance Registry with case number, description and location, owner, procedural status, actions taken and costs incurred. The regulation says it is updated at least once a year and that publishing it on the portal is optional,22 but Article 4.011 of the Code requires quarterly updates and public availability, and where they differ the Code controls.23
The Community Land Bank: the piece Jayuya added in 2025
Months after the nuisance regulation, Jayuya created its Community Land Bank by ordinance: Ordinance 1 (Series 2025-2026), approved on August 20, 2025 and signed the next day.32 It is a municipal nonprofit corporation (Article 4.005 of the Code and Law 164-2009) that can receive properties, including those acquired as a result of the public nuisance management program33. The circuit connects with this regulation in both directions: the Bank can refer cases to the municipal office so a declaration is initiated under Ordinance 42, Series 2024-202534, and the ordinance itself provides that Ordinance 42 remains in force35.
Transfers are not automatic: the Mayor proposes which properties go to the Bank, each transfer requires a resolution of the Municipal Legislature36, and the Bank may decline any offer37. When disposing of its holdings, the first priority of use is affordable housing, workforce housing, and public housing38, followed by community economic development, public-use spaces, flood mitigation, beautification, and conservation.
Two programs put that policy on the ground. Under the Lot Transfer Program, vacant Bank lots can go to adjoining owners: one lot per recipient, no municipal or property-tax debts, with a repurchase clause requiring the lot to remain a green, unbuilt area39, barring its segregation, lease, or transfer for ten (10) years40; and if the property came from the nuisance program, the Bank may charge back the cleanup or demolition previously paid41. Under the Housing Delivery Program, uninhabited Bank houses may be sold, leased, or assigned to indigent persons to provide affordable housing42, with the same ten-year lock and principal-residence use.
What Act 97-2026 changed that the regulation does not capture
The regulation is from May 2025; Act 97-2026 amended the Municipal Code on June 1, 2026.3 Where they differ, the Code controls:
- The deadline to perform the works: 30 days, not 60.31 Act 97-2026 cut from sixty (60) to thirty (30) days the Article 4.010 term to perform the works after notice of the declaration; the regulation still says sixty.
- Heirs: 3 years, not 5. The regulation says property whose heirs claim it late is adjudicated to the municipality after more than five (5) years.24 The Code in force reduced that term to three (3) years.25
- Unknown owner: 1 year. The reform added that if no titleholder or person with a real right appears and more than one (1) year passes from the declaration, the property can be adjudicated to the municipality ex parte, a route the regulation does not mention.26
- Occupied principal residence: here Jayuya was ahead. Its regulation already provides that a structure used as the principal residence of a possessor exercising acts of dominion is not considered a public nuisance, in line with the Code's new Article 4.010(g).27
- The registry: annual updates and optional publication yield to Article 4.011 of the Code, which requires a quarterly inventory available to the public.
- The quarterly fine: a flat $3,000 falls within the Code's $1,000 to $5,000 range;30 no conflict, just a single figure where the Code gives a range.
