Public nuisances in Hormigueros: the first of the new wave, and Ordinance 9

Hormigueros adopted its public nuisance regulation through Ordinance No. 9, Series 2024-2025, passed by the Municipal Legislature on September 18, 2024 and signed by the mayor on September 19, 2024.1 It repeals Ordinance 12, Series 2020-2021. It was the first in the west to adopt, just weeks after Act 114-2024, the regulation template later replicated by municipalities like Juana Díaz, Loíza and Luquillo: default, fines that run by the month, and fixed fees per step. This guide walks the full process and closes with what Act 97-2026 left outdated.

How a case begins and your 30 days

The local definition requires the structure to be uninhabited and abandoned: it is indispensable that the lot or structure not be occupied by anyone.5 Cases are handled by the Municipal Administration Office (which the regulation calls the Department), on its own initiative or on any citizen's complaint, with a public form,6 and agreements with community organizations to build inventories are allowed. The investigation looks for owners at CRIM, the Property Registry and the Corporations Registry.

If there are grounds, a preliminary determination is served with the alleged faults. From that notice you have thirty (30) calendar days to request an administrative hearing before an Examining Official, or to oppose through a written answer within the same term.7 Notice arrives personally or by certified mail, re-sent by regular mail if returned unclaimed; if whereabouts are unknown or the property is unrecorded, a notice is published in one newspaper and one digital outlet, with no court order, and a copy is posted in a visible spot on the property.8

If you neither answer nor appear, default is entered: it is taken as acceptance of the property's condition and the Department is authorized to directly issue the final declaration resolution.9 And once default is entered, later fines and communications are no longer served on you: they accumulate in the case file.10

The hearing and the terms to cure

If you appear, the Examining Official appointed by the Mayor decides in writing (the regulation does not require an engineer or attorney, but Article 4.009 of the Municipal Code does, and where they differ the Code controls). If the declaration proceeds, the order grants up to thirty (30) calendar days to eliminate the faults,11 with extensions for proven extraordinary circumstances (the Department weighs in within ten days): combined, up to ninety (90) days for demolition and cleanup and up to one (1) year for the rest.12 Once the term lapses, or without an appearance, the Municipality may close, repair, clean or demolish starting sixty (60) calendar days after notice of the final resolution.13

The fines: the clock runs monthly

Hormigueros adopted the model's three independent fines. The escalating monthly fine runs for the mere existence of the nuisance, grounded on Articles 1.009 and 1.039 of the Code, accruing automatically until the condition is cured.14 Added to it are the $5,000 quarterly fine when the municipality had to clean because of your inaction15 and the repeat-offense fines when a closed property relapses.16

On top of the fines comes the fixed fee per step, collectible with the final declaration alone: $60 per inspection, $40 per follow-up, $150 for the preliminary report, $35 for the complaint, $55 for the sign, $45 for the registry investigation and $450 in legal costs, plus a 10% administrative charge.17 If the municipality cleans, it charges $500 per debris trip, $3.20 per square meter of lot, labor by the hour plus 35%, and machinery per FEMA's equipment rate schedule.18

Forgiveness exists: you can ask the Department or the Examining Official to cancel or suspend the fines for force majeure, CRIM contact-information errors (proving the update attempt), a principal residence occupied by a possessor with dominion, the lifting of default, disabling illness, or rehabilitating the property.19

Buying a nuisance property in Hormigueros

Acquired properties can be retained for municipal use, transferred to the Article 4.005 Land Bank (the official text even preserves a bracketed template note reading if the Municipality has one),20 donated to nonprofits, or disposed of through the mechanisms of Chapter IV of the Code. For a buyer, the routes are the Code's: the Article 4.012 expropriation (with the letter of intent and its appraisal-plus-10% deposit), the summary route of Article 4.012A with its priority for buyers of properties rehabilitable as residences, and the 2.018 auction model. When expropriating, the Municipality deducts from just compensation the property taxes owed, the fines, and the cleanup and maintenance costs. As in the rest of the template, absolute title vests in the Municipality upon filing the petition with the Rule 58.3 declaration of acquisition, with a reversal clause if the title is annulled21 (Article 2.018(a)(10) of the Code, by contrast, has the Court issue the title within five juridical days). Seventy-five percent of sale proceeds feeds a revolving fund for the program, housing rehabilitation, the Community Land Bank, loan guarantees and subsidies for future sales.22

One distinctive trait: in Hormigueros the Municipal Legislature's approval for each expropriation and conveyance must be issued prior to the start of the process;23 unlike other municipalities with this template, the regulation does not contemplate later ratification. And one fact for homebuyers: the municipality later adopted Ordinance 26, Series 2025-2026, with an Affordable Housing Auction Regulation, a separate instrument registered at SUTRA.4

The Land Bank has existed since 2023 and was born for nuisance properties

The regulation's bracketed template note (the one about whether the Municipality has a Land Bank) has an answer: it does, since a year before the nuisance regulation itself. Ordinance 5 (Series 2023-2024), approved on August 2, 202332, establishes the Community Land Bank and orders the transfer to it of the properties acquired through the public nuisance program33, as part of the affordable housing and community development catalog34.31 Section 5 says it in full: its regulation is approved for the disposition of properties acquired through the Public Nuisance Management Program35.

The ordinance also leaves a snapshot of the program in 2023: in its first inventory phase, 74 properties had been declared, most without their owners appearing36. And it sets a sales philosophy designed for real buyers: properties sold in their current state with the buyer committing to make the improvements37, financing that can include owner financing and second-tier mortgages with favorable terms38, and restrictive conditions in the deeds so the properties remain affordable housing for others39. And the Bank is not a dead letter: in 2024-2025 the Legislature authorized assigning funds to BTC de Hormigueros, Inc. for the administrative management of its operations.40

What Act 97-2026 changed that the regulation does not capture

The ordinance is from September 2024; Act 97-2026 amended the Municipal Code on June 1, 2026.3 Where they differ, the Code controls:

  • The deadline to perform the works: 30 days, not 60.30 Act 97-2026 cut from sixty (60) to thirty (30) days the Article 4.010 term to perform the works after notice of the declaration; the regulation still says sixty.
  • Heirs: 3 years, not 5. The regulation says property whose heirs claim it late is adjudicated to the municipality after more than five years.24 The Code in force reduced that term to three (3) years.25
  • Unknown owner: 1 year. The reform added that if no titleholder or person with a real right appears and more than one (1) year passes from the declaration, the property can be adjudicated to the municipality ex parte, a route the regulation does not capture.26
  • Occupied principal residence: the local definition already excludes any occupied structure and forgiveness expressly covers the principal residence of a possessor with dominion, in line with the Code's new Article 4.010(g).27
  • The quarterly fine: the Code frames it as a $1,000 to $5,000 range; the regulation sets it at $5,000, the top.28 The escalating monthly fine is a separate track built on Article 1.009, with its own $5,000 maximum per fine.
