Public nuisances in Isabela: two regulations, a Committee with an ethics clause, and affordable auctions

Isabela is the municipality that has taken the system furthest: it first adopted an Affordable Auctions Regulation (Ordinance 36, Series 2023-2024, July 2024)4 and months later the Public Nuisance Declaration Regulation (Ordinance 6, Series 2024-2025, passed by the Legislature on December 3, 2024 and signed by the mayor on December 5, 2024, repealing Ordinance 30 of 2021-2022).1 With those two pieces it held Puerto Rico's first affordable-housing auction of public nuisances. This guide walks both regulations and closes with what Act 97-2026 left outdated.

How a case begins and your 30 days

Cases are handled by the Public Nuisance Program, attached to the Mayor's Office,5 on its own initiative or on any citizen's complaint with an available form, and agreements with community organizations to build inventories are allowed. The local definition has a unique nuance: it is indispensable that the lot or structure not be occupied by anyone at the time the property inspection is performed.6

If there are grounds, a preliminary determination is served: personally if your physical address is known, by certified mail if only a postal one exists (re-sent by regular mail if returned unclaimed), and for unknown owners or unrecorded properties, a notice in one newspaper and one digital outlet with no court order, plus a copy posted in a visible spot.7 From the notice, thirty (30) calendar days run to request a hearing before an Examining Official or to oppose in writing.8 If you do neither, default is entered: it is taken as acceptance of the conditions9 and later fines are no longer served on you; they only accumulate in the case file.10

If you appear, the Examining Official appointed by the mayor decides in writing (the Code requires a licensed engineer or attorney). The repairable order grants up to thirty (30) calendar days,11 with extensions (the Office weighs in within ten days) of up to ninety (90) days combined for demolition and cleanup and up to one (1) year for the rest.12 Once the property is declared, the Municipality may intervene starting sixty (60) calendar days later.13

On top of the fines comes the fixed fee per step: $60 per inspection, $40 per follow-up, $150 for the preliminary report, $35 for the complaint, $55 for the sign, $45 for the registry investigation and, the highest in the group, $1,000 in legal costs, plus a 10% administrative charge.17 If the municipality cleans, it charges $500 per debris trip, $3.20 per square meter, labor plus 35%, and machinery per FEMA rates.18 Forgiveness is narrower than in neighboring municipalities: it only allows reducing amounts, for CRIM contact errors, the lifting of default, disabling illness, or rehabilitation (it does not include force majeure or the principal residence, though the latter protection now applies through the Code itself).19

Buying through the Evaluation Committee

To dispose of properties, the mayor appoints a five (5) member Evaluation Committee (the Office director, a Program liaison, the municipal secretary and two public-interest representatives)20 with an unusual ethics clause: no one within the second degree of affinity or fourth of consanguinity of a member may submit proposals, nor may corporations where a member is an officer, shareholder, partner or owner.21

  • Methods: competitive process (auction or proposal evaluation with a point system), waiting lists, lotteries, or direct transfers of vacant lots to neighboring properties.22
  • Early selection, with locks: the Committee may award properties the Municipality has not yet acquired only if there is a final and firm declaration resolution and the expropriation is pending;23 the selection document must warn that it grants no title or right of claim, and the potential acquirer signs a full liability waiver in the Municipality's favor.24
  • Anti-speculation conditions: rehabilitation deadlines, resale and appreciation caps, right of first refusal and repurchase,25 usufruct or surface rights with the land retained, rooftop microgrid easements, public amenities and local hiring.
  • Affordable housing track (4.012A): the mayor may set a below-market price for people with limited access,26 using standards like Section 8, CDBG or HOME; the prequalified buyer has one (1) year plus a six (6) month extension to secure funds,27 and once a year passes from the final declaration without a transfer, the Committee may sell on the open market.
  • Third-party acquirer track (4.012): always through a competitive process even if letters of interest arrive; permitted uses: affordable housing (including rentals within Fair Market Rent), principal residence or local commerce; short-term rentals and investors are out;28 minimum price, the appraisal plus 10% in costs.

As in the whole family of regulations, absolute title vests in the Municipality upon filing the petition with the Rule 58.3 declaration, with a reversal clause29 (Article 2.018(a)(10) of the Code, by contrast, has the Court issue the title within five juridical days); 75% of sale proceeds goes to a revolving fund for the program, rehabilitation, the Community Land Bank, loan guarantees and subsidies;30 and every expropriation and conveyance needs Municipal Legislature approval, in advance or by later ratification.31 Compare the routes in 4.012 vs 4.012A and the general process in our acquisition guide.

The affordable auction: the other regulation

Ordinance 36 (Series 2023-2024) built the mechanism Isabela premiered in 2026: auctions of expropriated properties earmarked by ordinance for affordable housing.4 Its rules change the game for the residential buyer:

The legal justification sits in Article 2.040 of the Code: the need for affordable housing allows awarding to a bidder who is not the highest.41 Ties are resolved by lottery in the bidders' presence,42 and decisions are recorded in public minutes. That affordable track coexists with the municipality's formal auction machinery, which was also renewed: Ordinance 19 (Series 2024-2025), approved on April 30, 202552, adopted the new internal operating regulation of the Junta de Subastas53 and repealed the one in force since 2013 (Ordinance 13, Series 2013-2014).51 That body holds the responsibility for awarding the municipality's procurement auctions for goods, supplies, services, and construction projects54, under Articles 2.035 through 2.041 of the Code55. The SUTRA record contains the approving ordinance, not the articles; the full text must be requested from the Municipal Secretariat. For you this is context: the affordable auction of Ordinance 36 exempts you precisely from the guarantees required in those formal procedures, which follow their own regulation.

One more track, approved in the 2025-2026 series: Resolution 37 authorizes selling, without an auction requirement, municipal usufruct lands identified with uninhabited structures in a state of abandonment, with priority for heirs, adjoining owners, or community residents who own no other property.56

What Act 97-2026 changed that the regulation does not capture

Ordinance 6 is from December 2024; Act 97-2026 amended the Municipal Code on June 1, 2026.3 Where they differ, the Code controls:

  • The deadline to perform the works: 30 days, not 60.50 Act 97-2026 cut from sixty (60) to thirty (30) days the Article 4.010 term to perform the works after notice of the declaration; the regulation still says sixty.
  • Heirs: 3 years, not 5. The regulation says property whose heirs claim it late is adjudicated to the municipality after more than five years.44 The Code in force reduced that term to three (3) years.45
  • Unknown owner: 1 year. The reform added that if no titleholder or person with a real right appears and more than one (1) year passes from the declaration, the property can be adjudicated to the municipality ex parte, a route the regulation does not capture.46
  • Occupied principal residence: the local definition already requires the structure to be unoccupied at inspection time, and since June 2026 the Code adds with the force of law that a structure occupied as the principal residence of a possessor with dominion is not considered a public nuisance.47
  • The quarterly fine: the Code frames it as a $1,000 to $5,000 range; the regulation sets it at $5,000, the top.48 The escalating monthly fine is a separate track built on Article 1.009, with its own $5,000 maximum per fine.
