Coamo renewed its public nuisance process with Ordinance No. 8, Series 2024-2025, passed by the Municipal Legislature on October 21, 2024 and signed by the mayor on October 22, 2024.1 It repeals Ordinance 3, Series 2021-2022. Unlike the template several recent municipalities share, Coamo's tracks the Municipal Code's text closely: fines come in ranges, the summary procedure mirrors Article 4.012A, and it even transcribes the CRIM agreements of Article 7.071. Its distinctive traits are elsewhere: a Commission with a legislative seat, the Municipal Police serving notices, and a six-year anti-speculation clause for buyers.
The Commission: five officials and an annual report
The process is run by a Public Nuisance Commission with fixed membership: the head of the Planning and Economic Development Office (who presides), the Municipal Police Commissioner, the Municipal Secretary, the head of Emergency Management, and an official of the Municipal Legislature designated by its President.4 It meets once a month with a quorum of three5 (more often with prior notice), keeps its files at the Planning Office, and renders the Legislature an annual report of its work at the close of each fiscal year.6
Any citizen, neighbor, public or private entity, or the municipality itself can start a case with a complaint.7 Each file gets a number, is investigated with an on-site inspection and photographs, and owners are identified through the Property Registry and CRIM. If the property sits in the historic zone, nothing is altered or demolished without consulting the Built Historic Heritage Division of the Institute of Puerto Rican Culture and obtaining its approval.8

The notice and your 30 days
The intent to declare is served personally by the Municipal Police (or the official the Commission designates), who records on the back of the copy their signature, date, time, place and who received it.9 A sign announcing the intent is also posted on the property. If the owner's whereabouts are unknown or the property is recorded neither at the Registry nor at CRIM, the municipality certifies it and publishes a notice to an unknown person in one print newspaper and one digital outlet, with no prior court order.10
From the notice, thirty (30) days run to oppose and request a hearing before an Examining Official,11 who in Coamo is, correctly, a licensed engineer or attorney (who may be contracted, with the cost charged to the proceeding).12 If no one appears, the municipality may declare the property a public nuisance.
The hearing, the order, and one owner-friendly detail
The Examining Official's order can come out three ways: not a nuisance (case closed); repairable, with up to thirty (30) days to repair or clean; or not repairable, with demolition at the owner's expense within up to thirty (30) days, extendable by ninety (90) more.14 In the repairable case further extensions are possible for extraordinary circumstances, and here comes a unique detail: the Commission has ten (10) days to state its position on each extension, and if it fails to do so in time, its silence is deemed consent.13 The extensions combined never exceed one (1) year. Once the terms lapse, the municipality executes at its own expense and records the lien at the Registry.
Once the property is declared, you have sixty (60) days to clean or perform the work;15 otherwise the municipality does it, bills all costs, and whatever it cannot collect becomes a lien equivalent to a tacit legal mortgage with the priority of a tax debt.

The fines: Coamo follows the Code's ranges
Unlike municipalities that set single amounts, Coamo frames its fines just like the Municipal Code:

Fines are added to the cleanup cost. If you do not pay within sixty (60) days of the demand, the amount joins the tacit mortgage lien; and if collection fails for another sixty (60) days, the municipality files the court action to foreclose and sell the property at public auction,18 keeping what is owed and depositing the balance in a separate account from the General Fund.
Buying a nuisance property in Coamo: fast, but on a leash
The inventory of declared properties (location, registry description with liens, cadastre number, owner and appraisal) is available at City Hall and the municipality's digital platform, updated quarterly by the Commission.19 From there, the classic Article 4.012 route: you file your intent to acquire, deposit the appraised value plus ten percent (10%) for costs,20 and the municipality files the complaint under Rule 58. Coamo added its own accelerator: the lawsuit, from the answer to the complaint or the entry of default until the resolution on the merits, may not exceed one (1) year.21
Under the summary route of Article 4.012A, the ordinance mirrors the Code's terms: 20 days to answer (30 if served by edict), non-extendable, default and judgment in 5 days, trial in 15 to 30 days,22 appeal in 15, no deposit upon filing, and three (3) years to claim the compensation. It also copies the protections: priority for people with limited opportunities when the property can be rehabilitated as a residence, exclusion of third-party acquirers and investors, and the one-year grace period (plus six months) for the interested citizen to secure funds.
After the judgment come the buyer's obligations, and here Coamo is the strictest of the group:
- Record within 6 months: you must show the municipality evidence of recording the title at the Property Registry within six (6) months (same for the grouping deed if you bought groupable properties).23
- Rehabilitate or group within 1 year: otherwise the municipality may exercise the conventional repurchase right and take the property back.24
- The 6-year clause: the deed includes, as a restrictive condition and real lien, that if you sell, exchange, donate or transfer the property within six (6) years of the award, you reimburse the municipality everything that was forgiven at the sale.25 Heirs who receive by succession do not reimburse,26 unless they themselves transfer within the period; and there is an exemption if the price dropped for proven just cause.
The ordinance also transcribes the CRIM final agreements of Article 7.071 (for properties with debts of 75% or more of real value), with their prohibitions:27 no reselling or renting to the original debtor or their relatives up to the fourth degree, and no selling to relatives of the mayor or of the officials who intervened in the agreement. And it captures the Code's protection for vulnerable debtors: the municipality may postpone a tax-debt sale for taxpayers of advanced age or with a terminal illness or permanent disability, if it is their only property and permanent home and they lack the means to pay.28 The general buying playbook is in our acquisition guide and the comparison of routes in 4.012 vs 4.012A.
Emergencies: the Public Works shortcut
If the Commission's President certifies a real, verified emergency, where a lot or structure poses imminent danger to the neighborhood, Municipal Public Works may clean or demolish bypassing the ordinary procedure, billing the owner afterwards.29 The ordinance itself defines a real emergency as an unforeseen situation that, if not addressed quickly, can cause injuries to people and damage to property.
The other regime: municipal lots by color zones
Coamo also has its own standing regime for selling municipal lots, and it connects with nuisance properties at both ends. Ordinance 26 (Series 2022-2023), approved on April 24, 2023, groups municipal lots into seven color zones with CRIM values ranging from $75 to $200 per square meter38.36 For housing, the sale price may be below the appraisal value39; for industry or business, the full appraisal by a real estate evaluator40 is paid. Sale to the usufructuary, de facto possessor, lessee, occupant, or tenant of a built lot needs no public auction41, but unlike other municipalities, here every sale must be made by ordinance42: each transaction goes through the Legislature. The mayor executes the deed with prior approval of the Planning Board43, and the lease fee keeps running until the occupant pays the full price44. The CRIM letter annexed to the ordinance explains the arithmetic of the residential discount: the municipality's bare title is worth 20% of the lot's market value and the usufructuary's right 80%45, so the CRIM suggests setting the residential sale price at 20% of the zone's base value46.
And the system is used with nuisance properties: in 2020-2021 Coamo declared as public nuisances and sold eight usufruct lots in the urban core, and in 2024-2025 it declared nineteen and then six additional structures while authorizing their subsequent sale, all by ordinance.37
What Act 97-2026 changed that the ordinance does not capture
The ordinance is from October 2024; Act 97-2026 amended the Municipal Code on June 1, 2026.3 Where they differ, the Code controls:
- The deadline to perform the works: 30 days, not 60.35 Act 97-2026 cut from sixty (60) to thirty (30) days the Article 4.010 term to perform the works after notice of the declaration; the regulation still says sixty.
- Heirs: 3 years, not 5. The ordinance says property whose heirs claim it late is adjudicated to the municipality after more than five (5) years.30 The Code in force reduced that term to three (3) years.31
- Unknown owner: 1 year. The reform added that if no titleholder or person with a real right appears and more than one (1) year passes from the declaration, the property can be adjudicated to the municipality ex parte, a route the ordinance does not mention.32
- Inhabited structures. Section 1 of the ordinance authorizes declaring inhabited or uninhabited structures,33 but the Code's definition requires abandonment, and since June 2026 a structure occupied as the principal residence of a possessor with dominion is not considered a public nuisance. The Code controls.34
- The fines: no delta here. Coamo already frames them in the Code's exact ranges.
