Orocovis adopted its new public nuisance regulation on the eve of the reform: Ordinance 9, Series 2025-2026 passed the Municipal Legislature on May 26, 2026 and was signed by the mayor on May 27, 2026, five days before Act 97-2026 amended the Municipal Code.1 It repeals Ordinance 2, Series 2021-2022, in force since 2022. It is one of the most detailed and aggressive regulations in the country: fines that climb every month, fixed fees for each municipal step, and at the same time one of the most complete community purchase schemes. This guide walks through all of it and closes with what Act 97-2026 changed days later.
What counts as a public nuisance in Orocovis
The local definition follows the Code with two deliberate twists. First, it requires the structure to be uninhabited: the regulation provides that it is indispensable that the lot or structure not be occupied by anyone.4 Second, it purposely omits criteria the Code lists that the municipality considered arbitrary in application, such as lack of electricity or drinking water. In practice, Orocovis limited itself to abandoned, uninhabited structures in ruin, with construction defects, or harmful to health or safety.

How a case begins and your 30 days
The process starts on the Municipality's own initiative or with a complaint from any citizen, with a form available to the public.5 The regulation even allows agreements with community and nonprofit organizations to build inventories of potential nuisances. The investigation looks for owners at CRIM, the Property Registry and, if the owner is a corporation, the Corporations Registry of the Department of State.
If there are grounds, the Municipality serves a preliminary determination detailing the alleged faults. From that notice you have thirty (30) calendar days to request an administrative hearing before an Examining Official, or to oppose through a written answer within the same term.6 Notice arrives personally or by certified mail; if the mail comes back unclaimed, it is re-sent by regular mail. And if the owner's whereabouts are unknown or the property is unrecorded, the notice is published in a newspaper and on a digital platform, which can even be the Municipality's official social media, with no court order, and a copy is posted in a visible spot on the property.7
Default: what happens if you do not answer
Here is the regulation's toughest feature. If you do not request a hearing, do not answer in writing, or request a hearing and fail to appear, a default (rebeldía) is entered: it is taken as acceptance of the property's condition and the Municipality is authorized to directly issue the resolution declaring it a public nuisance.8 And the effect extends forward: once default is entered, later fines and communications are no longer served on you; they simply accumulate in the case file.9 Ignoring the first letter in Orocovis means never hearing about anything again.
The hearing and the order
If you appear, an Examining Official appointed by the Mayor decides in writing whether the declaration proceeds (the regulation does not require an engineer or attorney, but Article 4.009 of the Municipal Code does, and where they differ the Code controls). If it proceeds, the order grants a reasonable term of up to thirty (30) calendar days to eliminate the faults.10 Extensions are possible for proven extraordinary circumstances, with the Municipality weighing in within ten (10) days, but with caps: combined, ninety (90) days for demolition and cleanup orders, and one (1) year for all other cases.11 If the term expires without compliance, or if you never appeared, the Municipality may proceed with closure, repair, cleanup or demolition starting sixty (60) calendar days after notice of the final resolution.12

The fines: in Orocovis the clock runs monthly
The regulation creates three mutually independent fines. The most striking is the monthly one: for the mere existence of the nuisance condition, grounded on Articles 1.009 and 1.039 of the Code (not 4.010), the Municipality fines monthly on an escalating scale, and the fines keep accruing automatically until the condition is cured.13 On top of that come the $5,000 quarterly fine when the municipality had to clean or demolish because of your inaction,14 and the repeat-offense fines when an already-closed property falls back into nuisance condition.15

There is also a fixed fee for every step, collectible with the final declaration alone: $60 per inspection, $40 per follow-up inspection, $150 for the preliminary report, $35 for preparing and serving the complaint, $55 for the sign, $45 for the registry investigation, $450 in legal costs, plus a 10% administrative charge on the subtotal.16 If the municipality cleans, it charges $500 per debris trip, lot cleanup at $3.20 per square meter, labor by the hour plus 35% in fringe costs, and machinery per FEMA's equipment rate schedule.17
The escape valve is forgiveness (condonación): you can ask for fines to be cancelled or suspended, fully or partially, for force majeure, for errors in your CRIM contact information (if you can show you tried to update it), because the structure is occupied as the principal residence of a possessor exercising dominion, for the default being lifted, for disabling illness, or for rehabilitating the property.18
Buying a nuisance property in Orocovis: the community scheme
To dispose of acquired properties, the Mayor appoints a five (5) member Evaluation Committee that includes two public-interest representatives,19 alongside the municipal director, the nuisance program liaison and the municipal secretary. That Committee selects the properties, sets the criteria, evaluates offers, determines the price and even the payment method.
- Disposition methods: competitive process (auction or proposal evaluation with a point system), waiting lists, lotteries, or direct transfers of vacant lots to neighboring properties in exchange for upkeep.20
- Payment methods: the Committee may accept CDBG-DR or CDBG-MIT relocation vouchers, owner financing, or payment plans, except in the third-party acquirer track of Article 4.012.21
- Early selection: the Committee may award properties declared nuisances that the Municipality has not yet acquired, as long as the transaction is contingent on the acquisition completing, with no obligation if it does not.22
- Anti-speculation conditions: the deed can include rehabilitation deadlines, resale restrictions, a municipal right of first refusal and repurchase, resale price caps to control appreciation,23 usufruct or surface rights with the municipality keeping the land, rooftop easements for renewable-energy microgrids,24 space for public amenities, and local hiring requirements.
Under the affordable housing track (Article 4.012A of the Code), the Committee may set a sale price below market for people with limited opportunities in the traditional market,25 defining income with standards like Section 8, CDBG or HOME. The prequalified buyer has one (1) year from the disposition notice to secure funds, extendable six (6) months;26 failing that, the property goes to the next candidate, and once a year passes from the final declaration without a transfer, the Committee may sell it on the open market.27
Under the third-party acquirer track (Article 4.012), Orocovis imposed on itself a rule the Code does not require: even if letters of interest arrive, selection will always be through a competitive, transparent process. Permitted uses are affordable housing (including rentals within HUD fair market rents), principal residence, or small and mid-sized businesses and local commerce; short-term rentals and real estate investors are excluded.28 The minimum price is the appraised value, plus ten percent (10%) for transaction costs. Two more pieces close the scheme. The regulation provides that, when the Municipality files the expropriation petition with the Rule 58.3 declaration of acquisition, absolute title vests in the Municipality, which may arrange the disposition from that moment with a reversal clause if the title is annulled29 (Article 2.018(a)(10) of the Code, by contrast, has the Court issue absolute title within five juridical days). And all sale proceeds feed a revolving fund: 75% goes to the nuisance program, housing rehabilitation, the land bank, loan guarantees and subsidies for future sales.30 Every expropriation and conveyance requires Municipal Legislature approval, in advance or by later ratification.31
What Act 97-2026 changed five days later
The ordinance was signed May 27, 2026; Act 97-2026 is dated June 1, 2026.3 Where they differ, the Code controls:
- The deadline to perform the works: 30 days, not 60.37 Act 97-2026 cut from sixty (60) to thirty (30) days the Article 4.010 term to perform the works after notice of the declaration; the regulation still says sixty.
- Heirs: 3 years, not 5. The regulation says property whose heirs claim it late is adjudicated to the municipality after more than five (5) years.32 The Code in force reduced that to three (3) years.33
- Unknown owner: 1 year. The reform added that if no titleholder or person with a real right appears and more than one (1) year passes from the declaration, the property can be adjudicated to the municipality ex parte, a route the regulation does not capture.34
- Occupied principal residence: here Orocovis was ahead. Its definition already excluded any occupied structure and its regulation allows forgiving fines when the structure is the principal residence of a possessor with dominion, in line with the Code's new Article 4.010(g).35
- The quarterly fine: the Code frames it as a $1,000 to $5,000 range; the regulation sets it at $5,000, the top of the range.36 And the escalating monthly fine is a separate track, built on the general fining power of Article 1.009, which has its own $5,000 maximum per fine.
